- The LaChambre website – www.LaChambreBed.com and the mobile application (collectively the “Platform”) are operated by Caveman F&S Sdn. Bhd. (“we”, “us”, “our””) and/or its subsidiaries and affiliates.
ABOUT THESE TERMS
- By accessing and/or using the services available on the Platform, you agree to be bound by these terms and conditions Terms of Use (“Terms”). If you do not agree to these Terms, do not access and/or use the services available on the Platform.
- We reserve the right to review these terms at any time and you are deemed to be aware and bound by changes upon their publication on the Platform.
- You warrant that you have reached the age of majority to use the Platform to make legitimate purchases.
- In the event of conflict between these Terms and specific terms of use of other products and services on the Platform, such specific terms of use shall prevail.
- The availability of the functions, products, and services offered by the Platform may vary according to country or region. Should you choose to visit this website from countries or regions outside of Malaysia, you do so on your own volition and shall use our Platform as permitted by your local laws.
RESTRICTED USE OF THE PLATFORM
- You agree and undertake not to:
- impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity;
- use the Platform or the Products and Services for illegal purposes;
- violate any applicable laws and regulations;
- post any false, inaccurate, misleading, unlawful, harmful, threatening, abusive, tortuous, harassing, defamatory, libellous, invasive of another’s privacy, vulgar, profane, sexually oriented/suggestive/explicit, obscene, racially or ethnically offensive or otherwise objectionable materials or content;
- infringe any third party rights and intellectual property rights;
- use website crawlers, robots, data mining, extraction tools on the Platform;
- disassemble, reverse engineer, decompile or modify any software or application contained in or available on our Platform in whole or in part, or otherwise attempt to obtain or access the source code of our Platform;
- interfere, disrupt, damage or limit the functioning of the Platform via software viruses, trojan horses, worms, time bombs, cancelbots or any computer codes;
- linking the Platform without prior written approval of us; and
- use of any automated screen capture or screen scraping technologies to obtain information from the Platform without the prior written approval us.
CONTENT
- Whilst every effort is made to update the information contained on the Platform, we make no guarantees as to the authenticity, accuracy or completeness of any content on our Platform, including content provided by other users or our Business Associates.
INTELLECTUAL PROPERTY RIGHTS
- All intellectual property rights including but not limited to copyright, trademarks, industrial designs, trade dress, get-up, trade secrets, confidential information and any other intellectual property rights subsisting anywhere in the world, whether or not registered and including all applications for the same (“Intellectual Property Rights”), are owned by us, our affiliates, Business Associates or the respective third party owners (whether they are our Business Associates or otherwise). All information and materials on our Platform may not be published, modified, copied, reproduced, duplicated or altered in any way without our express written permission. If you violate these rights, we reserve the right to bring civil claims for, among others, damages or losses suffered. These violations may also constitute criminal offences.
- All marks, signs, logos, symbols, get-up or other designs (“Trademarks”) of third parties including the airlines (other than that owned by our affiliates or Business Associates) may be obtained by us through our business associates and are used and displayed on our Platform strictly for descriptive purposes only such as to indicate the kind, nature, characteristics, purpose, value, quality or quantity of the products/services from the relevant third parties. We do not claim any ownership to these third-party Trademarks and unless expressly stated, we do not assert any direct relationship or any association, endorsement or connection with the products, services and business of these third parties including the airlines by virtue of their Trademarks being featured on the Platform. The Trademarks of the relevant third parties as displayed or used on the Platform are intended to describe the products and service offerings on the Platform for the benefit of our customers and we are not related in any way to these third parties including the airlines and their respective services and business.
SECTION K: SECURITY
- We use industry-standard Secure Sockets Layer or SSL / Transport Layer Security or TLS encryption to protect your information. Although we would use our best endeavor to ensure security, we make no warranty in respect of the strength or effectiveness of that encryption and we shall not be held responsible for events arising from unauthorised access of the information you provide.
EVENTS BEYOND OUR CONTROL
- We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our control including, but not limited to, natural disasters, weather conditions, fire, nuclear incident, terrorist act, riots, war, arson attacks, strikes, government actions or restraints, network or system interruptions or breakdown, internet or communications breakdown, quarantine, epidemic, or pandemic.
GOVERNING LAW
- Access and/or use the services available on the Platform is governed by the laws of Malaysia and should there be any dispute arising, you further agree to submit to the exclusive jurisdiction of the courts in Malaysia.
GENERAL TERMS
- Entire Agreement – These Terms and the Privacy Policy constitute the agreement between you and us in relation to your use of the Platform.
- Cession – We shall be entitled to cede, assign and delegate all or any of its rights and obligations in terms of any relevant terms and conditions, policies and notices to any third-party.
